1. Agreement to Terms

By accessing and using Passport Photo Direct ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use this Service.

2. Service Description

Passport Photo Direct provides automated photo cropping and verification services to help create US State Department-compliant passport photos. Our service analyzes your photo for compliance with official requirements and generates formatted prints.

3. User Responsibilities

• You warrant that you own or have the right to use any photo you upload
• You are responsible for ensuring your photo meets State Department requirements
• You consent to facial geometry extraction for compliance verification only
• You agree to use this Service for lawful purposes only
• You agree not to upload images of other individuals without consent

4. Photo Data

Temporary Processing: Your original photo is processed only to generate compliant formats. Original photos are not permanently stored.

Digital Copies: You retain download access to your digital 2"×2" photo for 30 days after order fulfillment. Archived copies are available upon request for 1 year. After 1 year, photos are permanently deleted.

5. Refund Policy

Eligible for Refund:

• Orders canceled before processing begins (within 24 hours of purchase)
• Unshipped orders that can be canceled
• Orders with demonstrable print defects caused by our printing process

Not Eligible for Refund:

• Orders already shipped or printed
• Photos rejected due to customer error, guideline non-compliance, or image quality issues
• Photos that do not meet State Department requirements (unless due to our processing error)
• Custom changes to an existing order after printing has begun
• Refunds requested more than 30 days after purchase

6. Limitation of Liability

Disclaimer: This Service is provided "AS IS" without warranty of any kind, either express or implied.

We are not liable for:

• Passport application rejections or delays caused by photo non-compliance
• Loss of travel opportunities or damages resulting from photo issues
• Fees charged by passport agencies or consulates
• Loss of data due to system failures or force majeure events
• Indirect or consequential damages of any kind

Our Liability Cap: Our total liability for any claims arising from this Service shall not exceed the amount you paid for your order.

7. Third-Party Services

This Service uses third-party payment processors (Stripe) and may use printing partners. We are not responsible for issues arising from these providers' services.

8. Modifications to Service

We reserve the right to modify, suspend, or discontinue this Service at any time, with or without notice.

9. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the United States and applicable state laws, without regard to its conflict of law provisions.
